Luis Diaz’s red card for Bayern was dismissed despite the referee saying it was the wrong decision

Bayern Munich have lost an appeal against Luis Diaz’s one-match suspension for a Bundesliga ban, even though the referee admitted his decision was not the right one.

Díaz was sent off after receiving a second yellow card for scoring in Bayern’s 1-1 draw against Bayer Leverkusen on Saturday, in which he also scored Bayern’s only goal.

Since it was a yellow card, there was no question of video review. After watching a replay in a postgame TV interview with Sky Sports GermanyChristian Dingert said he had missed the contact between Diaz and goalkeeper Janis Blaswich and added: “The second yellow card is very harsh and when I see the images now I wouldn’t give it like that again.”

However, that was not enough for the German Football Association sports ground to overturn the automatic one-match ban and be sent off.

Court chairman Stephan Oberholz ruled on Monday that Dingert’s comments were not relevant and that it was not a «completely wrong» decision because Diaz had contacted the opposing goalkeeper.

«The decisive factor is that the incident is a factual decision that can only be corrected if it is seriously, clearly and beyond a reasonable doubt objectively incorrect. That is not the case here,» he said in a statement.

Diaz must serve the suspension against Union Berlin on Saturday. Bayern can appeal the ruling.
